In my letter to you dated March 14, 1985, I informed you that the search l

for and review of documents that are subject to your FOIA request were continuing. The search has now been completed, and no adoitional documents were identified as being subject to your request.

l FREEDOM OF INFORMATION ACT REOUEST

Dear Mr. Felton:

Pursuant to the Freedom of Information Act, 5 U.S.C. 522, as amended, the Nuclear Information and Resource Service requests the following documents regarding the possible limitations to the Commission's authority to consider financial matters in Commission actions including decisions in matters of licensing.

Please consider " documents" to include reports, studies, test results, correspondence, memoranda, meeting notes, meating minutes, working papers, graphs, charts, diagrams, notes and summaries of conversations and interviews, computer records, and any other forms of written communication, including internal NRC Staff memoranda.

The documents are specifically requested from the Office of the Executive Legal Director (OELD) and the Office of the General Counsel (OGC).

Pursuant to this request, please provide all documents prepared or utilized by, in the possession of, or routed through the NRC related to:

1. The question of possible limitations to the consideration of financial raatters in the Commission's actions and decisions on licensing allowed or contemplated by the Atomic Energy Act and other authority granted to the Nuclear Regulatory Commission.

In our opinion, it is appropriate in this case for you to waive search charges, pursuant to 5 U.S.C. 552(a) (4) (A) "because furnishing the information can be considered as primarily benefiting the general public."

The Nuclear Information and Resource Service is a non-profit organization serving local organizations concerned about nuclear power and providing infor-mation to the general public.

The Commission recently made a decision in the matter of the restart of the San Onofre Nuclear Generating Station Unit 1 in which the financial straits of the licensee, Southern California Edison Company, played an important role.

NIRS is seeking to provide an analysis of the Commission's decision and requires the opinions of the OELD and OGC for this WOGlCO ?;p- 0nrL
