Plea se be advised that the County Attorney's Office will be unable to file a substantive brief with regard to the above issua since our legal files, t rans cript s, exhibits, etc., have not baen returned to us by the Kirkpatrick & Lockhart law firm.
We
. do, however, wish to advise the Appeal Board that the County of Suf f olk has not in any way altered its position concerning the caf ety and ef ficacy of the diesel generators now installed at the Shoreham facility.
To date, this office has seen nothing that would ease our previously expressed concern over safety issues.
We believe the Kirkpatrick & Lockhart law firm will be filing a brief on this issue with the Appeal Board, and upon receipt of same, this office will review the information set out therein.
