NRC STAFF'S MOTION FOR EXTENSION OF TIME Pursuant to 10 C.F.R 62.730, the NRC Staff (" Staff") hereby requests an extension of time of four days, until July 19, 1985, in which to file its response to Applicant's appeal from the Partial Initial Decision on emergency planning of April 17, 1985.

In support of this request, the Staff states as follows:

1.

Pursuant to scheduling orders issued by the Appeal Board, the Staff's brief in response to Applicant's appeal is currently due to be filed on or before July 15, 1985.

The Applicant may request leave to reply to Intervenors' and Staff's briefs on or before July 23, 1985; and oral argument of Applicant's appeal is scheduled to be held on August 12, v

The undersigned attorney has been assigned to prepare the Staff's brief in response to Applicant's appeal. Due to medical prob-lems affecting a member of his family, the aforesaid attorney has been requiredto'beawayfromtheof[iceforapproximatelytwoweeksduring the past month.

of four days in which to complete and file the Staff's brief in response to Applicant's appeal.

Counsel for the Staff has contacted Counsel for the Applicant, Counsel for State of New York, and Counsel for Suffolk County (both Kirkpatrick and Lockhart and the Suffolk County Attorney), and has been authorized to state that those parties do not object to the grant of the instant request.

In addition, the Applicant has authorized the Staff to state that it does not presently desire a corresponding exten-

.sion of time in which to seek to reply to the Staff's brief, and that a determination as to whether it will seek such an extensfon will be r

ter it has received the Staff's brief.

WHEREFORE, the Staff respectfully requests an extension of time of four days, until July 19, 1985, for the filing of its brief in response to Applicant's appeal from the PID on emergency planning of April 17, 1985.
