Dear Mr. Temus:
Enclosed is one copy of a draft Technical Evaluation Report (TER) on the NuPac FL-50/EA-50 High Integrity Container (HIC) topical report. We have completed our review of your topical report and have forwarded copies of the draft TER to the States of South Carolina and Washington for review and comment along with draft Certificates of Compliance. Upon the acceptance by the States of the draft TER, as signified by their signing of the Certificates of Compliance, the FL-50/EA-50 HIC will be accepted for use at the respective State low-level waste disposal site.
We are temporarily treating the draft TER as proprietary and have forwarded this copy to you so that you may have the opportunity to examine it to determine whether we have inadvertently included some proprietary information. We have carefully considered the information included in the draft TER and believe that none of it is proprietary, but we would like you to confirm that. As you know, final acceptance of your topical report is predicated on the submittal of acceptable proprietary and non-proprietary versions of the reviewed and approved topical report. Your prompt attention to this matter will ensure the avoidance of any unnecessary delay in gaining full approval of the use of your HIC.
