Dear Miss Shoemaker:

Yesterday we received a copy of a pleading filed by Mr.

Romano on behalf of himself and Air & Water Pollution Patrol

("AWPP"), entitled " Notice of Appeal by Air & Water Pol-lution Patrol / Romano re the ' Fourth Partial Initial Decision (On Offsite Emergency Planning Contentions Relating to Graterford).'"

Mr. Romano avers that the pleading is an appeal by AWPP/ Romano per 10 C.F.R. 52.762. However, he misdirected the pleading to the Atomic Safety and Licensing Board.

Also, although entitled a " Notice of Appeal," the pleading apparently constitutes the brief by AWPP/ Romano on the merits of the Fourth Partial Initial Decision.

Without getting into the merits of AWPP's standing to appeal a decision unrelated to his ' contentions and based upon a hearing in which it did not participate, the regu-lations under 10 C.F.R. S2.762(c) require that the Appli-cant's responsive brief must address the briefs of all appellants. Accordingly, unless otherwise directed by the Appeal Board, the Applicant will not respond to AWPP's brief, if at all, until 30 days after service of the appeal h50001g"0850730
