I COMMENT RESOLUTION In their vote sheets, all Commissioners approved the staff proposal and some Commissioners included comments. All the comments were included in the resulting SRM except for one item noted by Commissioner Diaz. He requested that a statement be included in the FRN to the effect that the staff was confident that Massachusetts could meet the new IMPEP criteria. A majority of the Commission disagreed with that addition. Subsequently, the comments of the majority of the Commission were incorporated into the guidance to staff as reflected in the SRM issued on December 17,.1996.

AGREEMENT BETWEEN THE COMMONWEALTH OF 1 MASSACHUSETTS AND THE COMMISSION PURSUANT TO SECTION 274 OF THE ATOMIC ENERGY ACT OF 1954, AS AMENDED l

i l The Commission has approved the staff recommendations in the subject paper with incorporation of the following comments.

1) The proposed letters to the Congressional oversight committees should be revised to include a copy to the Massachusetts delegation.

i

2) In the last line of the proposed Agreement replace 1

' Boston, Massachusetts' with ' (location to be determined).' .

3) On page 2 of the proposed Agreement, in the second full l paragraph, line 2, delete the 's' at the end of

' cooperations.'

As the Commission nears approval of the final Agreement, the staff should expedite, to the extent possible, closure of any actions involving Orders or escalated enforcement with Massachusetts licensees. Whenever possible, the staff shouldso resolve any open cases that involve enforcement and Orders, that the cases' outcomes are final before the date of Agreement signing. The staff should briefly address this issue in the paper that provides the final Agreement to the Commission, i (EDO) (SECY Suspense: 4/4/97) i 4
