MILLSTONE NUCLEAR POWER STATION, UNIT 1 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE d

Dear Mr. Kenyon:

By letter and affidavit dated October 29, 1996, Northeast Nuclear Energy Company (NNECO) submitted a report "... On the Investigation Into certain Concerns Related To The Millstone Unit 1 Radwaste Facility" (Appendix A in its submittal) in response to NRC Inspection Report No. 50-245/96-03. The report is identified by NNECO as containing personnel information (i.e., names and other identifying information).

NNEC0 requested that such privacy information in the submittal be withheld from public disclosure pursuant to 10 CFR 2.790 l

of the Commission's regulations. A redacted version of the report has also been submitted for placement in the NRC Public Document Room.

We have reviewed NNECO's request based on the requirements and criteria of 10 CFR 2.790, and have determined that the submitted information sought to be withheld contains privacy information. Therefore, the privacy information so identified by NNEC0 will be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding information from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of the information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC.

You should also understand that the NRC may have cause to review this determination in the M
