Administrative Law Judges Margulies, Kline, and Shon, and All Other Recipients of Revision 5 of the Shoreham Offsite Emergency Plan SHOREHAM OFFSITE EMERGENCY PLAN: REVISION 5 Gentlemen:
Long Island Lighting Company has sent to you under sep-arate cover Revision.5 to LILCO's Local Offsite Radiological Emergency Response Plan for the Shoreham Nuclear Power Station, along with the submittal letter to the Nuclear Regulatory Com-mission, which has been given serial number SNRC-1198.
The purpose of this letter is to outline the principal changes set forth in Revision 5 of the LILCO Plan.
The changes fall into 11 areas, each of which is dis-cussed briefly below, along with a listing of pages of the Plan itself, Appendix A, and the Implementing Procedures af fected by that area of' change.
As with previous revisions to the Plan, Revision 5 changes are denoted by markings in the right-hand margin:
vertical bars denote the addition or replacement of material in Revision 5; horizontal bars de' note its deletion in Revision 5.
Contrary to the practice with previo.us revisions to the Plan, LILCO has reproduced for holders of the Plan all pages of. the Plan, Appendix A',
and Implementing Procedures, not just Revision 5 pages, to alleviate the need for planholders to go through the tedious process of replacing each outdated page in the document with Revision 5 pages.
Thus, while the Revi-sion 5 package sent you includes all pages of the Plan, Appen-dix A, and Implementing Procedures (Revisions 0-5 (not just the Revision 5 pages)), only pages marked "Rev. 5" in the bottom right-hand corner have been changed.
Instructions for handling the Revision 5 package are included as Attachment I to SNRC-1198.

1 The changes made in Revision 5 are by and-large con-firmatory or. ministerial, in response to the need (1) to com-plete the requisite annual update of details that routinely change over time, such as addresses, document references, let-ters of agreement, and the like (see areas 2, 8, 9, 11), (2) to conform the Plan to testimony given by LILCO before the Atomic Safety and Licensing Board, to the Partial Initial Decision is-sued by that Board, and to commitments to FEMA in response to RAC comments (see areas 1-5, 10);'and (3) to fine-tune details of implementation, taking into account training and drill expe-rience (see areas 2, 6-8, 10).
As with previous revisions to the plan, the number of pages included as changed is misleading as to their aggregate complexity.
Alteration of even one word on a page requires labeling the entire page Rev. 5; numerous pages have only one or a very few lines changes as the result of, e.g., an organizational name change; various changes, while relatively straightforward in themselves, must be propagated through the Plan, Appendix A, and Implementing Procedures for consistency, resulting in changes to significant numbers of pages.
Changes in organizational names or job titles afford one example.
Changes due to the movement of relocation centers in Suffolk County to a reception center and congregate care centers in Nassau County is another, necessitating changes in 121 total pages including 20 maps.
That the number of pages changed represents a change of detail in implementation, and not in concept or planning basis, is underscored by the fact that the majority of changed pages are in the Implementing Pro-cedures.
Finally, a note regarding the legal authority section
- of the Plan (Section 1.4) is.in order.
As you no doubt know, the legal authority under state law for certain of LILCO's ac-tions contemplated under the Plan is being litigated in Cuomo v.
LILCO, Consol. Index No.84-461 (N.Y.S.C.,
Feb. 20, 1985),
and an appeal is pending before the New York Appellate Divi-sion, Second Department; the issue of federal preemption of certain state laws by the Atomic Energy Act, decided in Long.
