Dear Mr. Miraglia:

In accordance with 10CFR140.6{a), Toledo Edison hereby submits.the following written report of a pending lawsuit filed against'centerior Service Company and Toledo Edison Company claiming harmful exposure to radioactive materials at the Davis-Besse Nuclear Power Station.

Toledo Edison Company is the licensee for the Davis-Desse Nuclear Power Station.

.This' document details the time, place and circumstances of the event.

On October 7, 1994, at the Davis-Pesse Nuclear Power Station, six contractor radiation workers were exposed to radioactive material while removing insulation from the east once Through Steam Generator (OTSG) hot leg.

On November 23, 1994, the Nuclear Regulatory Commission (NRC) issued a

' Severity Level IV violation r',ating to the company's failure to follow written procedures limiting personnel exposures which is documented in NRC

' Inspection Report 96-010 dated November 23, 1994.

On August 7, 1995, a civil action was filed against Centerior Service Company and Toledo Edison Company in the United States District Court for the Northern District of Ohio, Eastern Division, Case No. 1:95 CV 1732, by the six workers in regard to the unplanned exposure to radioactive materials.
