Dear Mr. Palomino:

In our telephone conversation yesterday, you advised me that, on. September 17, 1985, you sent a letter by telecopier to the Appeal Board to the effect that you would represent the State of New York at the oral argument on September 26 of the State's appeal from LBP-85-18, 21 NRC 1637 (1985).

Unfortunately, that letter did not reach the Board and, accordingly, the Board had assumed that the State did not plan to participate in the argument.

Should you elect in the future to employ a telecopier in transmitting documents to the Appeal Board, it might be

advisable out of an abundance of caution to follow up the telecopier transmission with a mailed copy of the same document.

Alternatively, you might wish to have your secretary provide telephonic notification to the Appeal Board (301-492-7664) that a document is being transmitted to the Eoard by telecopier.
