NRC-33-94-172 Modification No. 5 Page 2 of 3 This modification is issued to (1) deobligate exce.ss funds in the amount of

$7.600.00 thereby decreasing the obligated amount from $625,000.00 to

$617.400.00: (2) Incorporate. Subsection F.5 - Re:.olving NRC Contractor i Differing Professional Views (DPVs); and (3) revise Section J.1 - LIST OF ATTACHMENTS to delete Attachment 01 - Billing Instructions, incorporate the revised " Billing Instructions for Cost Reimbursement Type Contracts", and incorporate Attachment 07 - Procedures for Resolving NRC Contractor Differing Professional Views.

Accordingly, the following changes are hereby made:  ;

1. Paragraph (b) under Subsection 8.3 - CONSIDERATION AND OBLIGATION--COST l REIMBURSEMENT. is hereby deleted in its entirety and substituted with '

the following in lieu thereof:

"The amount presently obligated by the Government with respect to this contract is $617,400.00."

2. Subsection F.6 - RESOLVING NRC CONTRACTOR DIFFERING PROFESSIONAL VIEWS (DPVs) is hereby incorporated in full text as follows:

"F.6 - RESOLVING NRC CONTRACTOR DIFFERING PROFESSIONAL VIEWS (DPVs)

The Nuclear Regulatory Commission's (NRC) policy is to support the contractor's expression of professional health and safety related concerns associated with the contractor's work for NRC that (1) may differ from a prevailing NRC staff view. (2) disagree with an NRC decision or policy position, or (3) take issue with proposed or established agency practices. An occasion may arise when an NRC contractor, contractor's personnel, or subcontractor personnel believes l

'that a conscientious expression of a competent judgement is required to  !

document such concerns on matters directly associated with its performance of the contract. The procedure that will be used provides i for the expression and resolution of differing professional views (DPVs) of health and safety related concerns associated with the mission of the agency by NCC contractors contractor personnel or subcontractor personnel on matters directly associated with its performance of the contract, may be found in Section J. as Attachment 04. The contractor shall provide a co]y of the NRC DPV procedure to all of its em)1oyees performing under tais contract and to all subcontractors who s1all, in turn, provide a copy of the procedure to its employees. NOTE: The prime contractor or subcontractor shall submit all DPV's received but need not endorse them."

3. Section J.1. entitled " List of Attachments." is hereby revised to replace the Billing Instructions listed as Attachment No. 01, with the Billing Instructions hereby attached as part cf this modification and to incorporate Attachment No. 04 entitled. "Precedures for Resolving NRC Contractor Differing Professional Views" which is also attached as a

~ part of this modification.

All other terms and conditions of this contract remain unchanged.
