INVESTIGATION 0F TMI-2 POLAR CRANE ALLEGATIONS l
You and Harold Denton and Dick DeYoung met last Friday on this issue.
I understand now that you indicated your willingness to provide us with your view on the issues of " deliberateness, willfulness and/or intent." Depending on how you come out on this issue, we would then be in a position to revise any applicable staff positions or enforcement actions. When you provide us with your views on this subject, please include references to those sections in the investigation reports we received or any other material that would apply. We must have these references to support any revisions in staff positions. As you know, we have questions from Chairman Udall awaiting answers on this matter.
I do not think we should delay answering these questions much longer.
Could you get us a reply by next week so that we can take whatever actions needed and get a prompt reply back to the Congress.
j I would also like to emphasize the points made in my September 21 memorandum to you on the need for 0! conclusions on a generic basis. We would save a good deal of misunderstanding if we could have the expert views of OI on these very difficult issues of wrong-doing, wi11 fulness, etc.
If you think h need a Consission dec.ision on this matter, please rely on my help in any discussions that might be needed with the Cosaission.
