Dear Ms. Satern:

This letter is in response to your letter of March 15, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), seven categories of records relating to contracts between the NRC and Binder, Elster, Mendelson, and Wheeler, Inc. (BEMW). This letter confirms the information discussed during the telephone conversation between you and David Meyer of my staff on April 1, 1985, regarding your F0IA request.

In this telephone conversation, Mr. Meyer informed you that, with regard to Category 5 of your request, the NRC routinely makes contracts and their modifications available in the NRC Public Document Room (PDR). The earliest procurement with BEMW was by purchase order; therefore, no related Request for Procurement (RFP) or proposal is available. With regard to category 3, the

. NRC has already made available in the PDR a non-proprietary version of the successful proposal submitted by BEMW under Contract No.82-358 in response to F01A-82-112. We suggest you review this document to give you some idea of the type of information made available in a non-proprietary version.

With regard to the additional records that you are requesting, the staff estimates that search time expended by professional staff will be a minimum of twelve hours. Under 10 CFR 9.14 of the Commission's regulations, a charge of

$12.00 per hour is assessed for professional search time. In an effort to keep your costs to a minimum, you may wish to consider limiting the scope of your request. Perhaps if you were to limit your request to those records pertaining to the most recent BEMW contract, you could obtain the information you desire at less cost.
