Dear Representative Concannon:

This letter is a followup to our telephone conversation of August 29, in which I encouraged the participation of a representative from the Nuclear Energy Advisory Council to observe the conduct of the NRC's oversight of the Independent Corrective Action Verification Program (ICAVP) at Millstone Unit 3.

Since, we have also extended a similar offer to Mr. Kevin McCarthy of the Connecticut Department of Environmental Protection, the Governor of Connecticut's designated NRC liaison, to name a State employee to observe NRC's ICAVP oversight process, we suggest that the participation of the Council be limited to a single observer.

You indicated that you would prefer to have both yourself and Mr. Evan Woollacott, the Council Co-Chair, designated as observers, since you and Mr. Woollacott have different areas of expertise. We continue to believe that the number of individual observers should be limited to two.

The basis for our preference to limit the number of individual observers to two is to balance the administrative burden placed on the NRC team by the observers, for example, need for the team to escort the observers while in the Millstone plant, with the size of the team.

As an observer of the NRC oversight process, the designated Council representative would be requested to act in accordance with the enclosed protocol and would be encouraged to observe and provide comments on the ICAVP and all aspects of the NRC's oversight, including the approval of the contracted review organization and the ICAVP team members.

I would appreciate your apprising me by September 20, 1996, as to whether the Council will designate an observer.

If an observer representing the Council is designated, please have that representative and a designated alternate sign the protocol agreement and return it with your reply.

Due to the timeframe over which the ICAVP process will take place and the fact that the review will to the maximum extent possible be conducted in the ICAVP contractor's offices, I would urge you to designate an alternate to the primary observer.
