This is to advise you that the Commission (with Chairman Palladino and Commissioners Roberts and Zech agreeing) has decided not to issue the proposed rule on ATWS that would require diverse SCRAM system for Westinghouse plants.

Commissioners Asselstine and Bernthal disaaree and would have issued the proposed rule for public comment.

I Commissioner Asselstine noted that:

"This Commission as presently constituted is over-turning a prior Commission decision to obtain public comment on whether or not it is reasonable to seek additional assurance that the SCRAM system in Westinghouse designed plants will function when called upon.

Given the nature and frequency of both common cause failures and oversights that affect reactor safety, I would not be as sanguine as this Commission."
