-3 Commissioner Asselstine adds:
I agree that the Commission itself should not conduct any further hearings that may be required in the TMI-l restart case.
In addition to the amount of the Commission's time that would be required for such an effort, I suspect that the Commission itself is not the most capable group to conduct an ad-judicatory proceeding.
However, the Commission should make a prompt decision on the need to reopen the record and should direct that any further hearings proceed as expeditiously as possible, consistent with the requirements for fairness.
It would be in-excusable for the Commission to take another several months to p.
decide whether further hearings are needed.
