Dear Mrs. Ellis and Mr. Roisman:
This will confirm our agreement that Applicants will provide to CASE a list of all pending CASE interrogatories and Appli-cants' position as to whether each is ripe for response by Applicants, in light of the Board Chairman's clarification of the Memorandum and order (Case Management Plan), dated May 24, 1985, as it pertains to discovery.
Applicants will-complete the preparation of~this list by June 7.
Thereafter, Applicants will respond to the ripe interrogatories on a phased schedule, with a final _ completion date of July 5,1985.
Based upon this approach, on which CASE and Applicants agree, we understand that there is also agreement as to the cancellation of the prehearing conference scheduled for June 3 and 4, 1985.
We also understand from discussions with Mr. Treby
-that the NRC Staff has no objection to this approach and the cancellation of the prehearing conference.
By a copy of this letter.to the Licensing Board, this will advise the Board that the parties have reached agreement on a course of and schedule for discovery, and that the parties considerthescheduledprehearingconferepce f o be unnecessary.
