Dear Mr. Loyson:

In recent months, several members of the. Division of Policy Analysis and Planning (DPAP) of the Louisiana.

Department of Environmental-Quality (LDEQ) staff have attended meetings with the Nuclear Regulatory Commission and Louisiana Energy Services representatives concerning_the development of a uranium enrichment facility to be located in Claiborne Parish, Louisiana.

The latest ef which was the NRC public scoping meeting on July 30, 1991 in the Homer'High School cafeteria attended by DPAP Administrator, John Glenn -

and Risk Assessment Coordinator, Stefan K. Teles.

While these meetings have-been quite~ informative, they have brought to light several issues which LDEQ feels should be part of the NRC acoping process and Environmental. Impact Statement for this facility.

Also, many of these issues will have to-be confronted before future operational permits from the LDEQ may be granted. -Among these.are questions concerning the choice of siting, the technology, plant and community safety, employee industrial hygiene,-economic feasibility, and socioeconomic effects of the proposed LES uranium enrichment facility in Claiborne Parish, LA.

As-you are aware, the LDEQ is operating under a si_ ting process mandated by the Article IX, Section 1 of the Louisiana Constitution, Title 30, Section 2014-of the Environmental Quality Act, and a Louisiana Supreme Court

well as the purity of' air and water before granting approval action by an individual or corporation which might negatively:

impact a constitutionally protected environmental value.

The Secretary, in considering any proposed action af fecting the environment must propose a balancing test, wherein the benefits of the proposed project are weighed-against harm to all constitutionally protected environmental values.

Specifically, the Louisiana Supreme Court has mandated that the Secretary consider, (1) whether the potential and real adverse effects of the proposed facility-have been avoided to the-maximum extent possible; (2) whether a cost-benefit-analysis of the environmental impact costs balanced against the social and economic benefits of the proposed f acility demonstrates that the latter outweighs the former:

(3) whether there are any alternative technologies which would offer more protection to the environment than the proposed f acility without unduly curtailing non-environmental benefits; (4) whether there are alternative sites which would offer more protection to the environment than the proposed facility without unduly curtailing non-environmental benefits; and

( 5) whether there are mitigating measures which-would offer more protection to the environment than che f acility as proposed, without unduly curtailing non-environmental benefits.

If this process results in a conclusion that constitutionally protected environmental values are negatively impacted to a greater extent than corresponding economic or social benefits would compensate, the Secretary has the duty to reject an application for that proposed facility, even though it-might otherwise meet regulatory standards.

The practical realities of this siting process are that the secretary must compile and analyze a considerable amount of data concerning the proposed facility.

Much of this information will be timilar to that required in the EIS process that the NRC is currently undergoing.

However, given the broader scope of the Secretary's mandate, it is probable that LDEQ's informational and/or mitigation requirements will-2

go well beyond those of the NRC's.

At a minimum, we will be interested in all relevant concerns regarding, (1) the selection of the Claiborne Parish site; (2) the storage and/or disposal of waste generated by the facility (at this time there is insufficient data to support the notion that all waste products will be reused or recycled);

(3) exact plans and technology for decommissioning the

-facility at the end of its useful life, including plans for storage, reuse or disposal of any recaining onsite wastes, and potential restrictions upon the site's use after decommissioning;-

(4) the likelihood of a release of a feed stock or whste into the environment, including Lake Claiborne, and the long and short term ' environmental impacts of such a release; (5) the positive economic impacts on the local community and the state of Louisiana as a whole; (6) the negative economic impacts on the local community and the State of Louisiana as a whole:

(7) whether the site is in, or near any areas of environmental, historic, cultural, or social significance, and the impact upon such areas; (8) the existing land use patterns in the areas surrounding the proposed facility; and (9) whether locating the facility at this particular site poses an undue health risk to the citizens of Louisiana.

The cost associated environmental impacts cannot always be quantified as easily as the economic benefits derived from taxes and salaries.

However, this by no means diminishes their importance in the Secretary's cost-benefit analysis.

Therefore, in order for the LDEQ to efficiently process any future state permit applications for the claiborne facility, LES must address all aforementioned issues as early in the siting process as is possible.

Therefore, inclusion of these issues in the NRC scoping process and the subsequent EIS is in the best interests of all concerned.
