Dear Mr. Johnson:

The above referenced letter, P-85083, transmitted a copy of Colorado Wastewater Discharge Permit C0-0001121 received March.5, 1985.

-Shortly after receiving this permit, Public Service Company (PSC) applied for and was granted a stay of the permit pending further discussions with the State of Colorado.

On ' April 12, 1985, PSC received a copy of a letter which was sent from the Environmental Protection Agency (EPA) to the State of Colorado (G-85131)'.

A copy of this letter is enclosed for your information. The letter states that the EPA

"...does not recognize

-or acknowledge the legal validity of this recently issued PSC Ft. St.

Vrain permit...".

Based on_ this action by the EPA, PSC and the State of Colorado negotiated a draft modification to the permit. A copy of the draft modification is enclosed for your information. On May 3, 1985, PSC received a copy of a letter which was sent from the EPA to the. State of Colorado (G-85166). A copy of this letter is enclosed for your

information. The letter states that "...the draf t modi fications do not satisfy our objections...".

Dear Mr-Schuyler:

We have reviewed the draft modification to the' pemit that was signed on February 21, 1985, for Public Service Company of Colorado's Fort St. Vrain generating station and we have the following coments:

1)

The draft modifications do not satisfy our objections to the lack of internal effluent limitations for the discharges from the sewage treatment plant, the drains from the reactor building and the turbine building, and.the lack of limitations or prohibitions on_ metal cleaning-wastes. See our letter of-April 8, 1985, to you for specifics.of our objections.

Because the holding ponds for the water supply will provide some additional settling, we believe the sampling point for TSS f

in the water supply should be after the holding ponds, not

before them.

3)

The requirement that discharges 001 and 002 not contain detectable amounts of the 126 priority pollutants except for total chromium and total zinc appears to be'a misapplication of-the effluent limitations guidelines (ELG). 'In 40 CFR 423.13 it specifies that in discharges of cooling tower blowdown there shall not be detectable amounts of the 126 priority pollutants contained in chemicals added for cooling tower maintenance,

except for total chromium and total zinc. The draft modification that allows an alternative to analyzing for the 126 priority pollutants partially resolves the problem.

However', there still is the problem of the wording of the effluent limitation and a conflict with the effluent limitation on total copper some of the heavy metal priority pollutants are likely to be present in the discharge in trace, but detectable amounts. A possible solution would be to add a footnote on pages.three and four that explains that it applies to chemicals added for cooling tower maintenance.

Dear Mr. Schuyler:

The above permit was originally subject to public notice in November, 1983. On Decenber 2, and December 23, 1983, conments and objections were provided to Judy Brtch, the permit writer, by Bob Burm and Bob Shankland of my staff. These court.ents ccncerned the fate of internal waste streans such as boiler blowdown, the sewage treatment plant, the turbine building stup, and metal cleaning waste streans.

It was reconmended that these streams have internal limits placed on them before dilution or that these discharges be prohibited.

Despite these objections, the permit was signed on February 21, 1985 and received by this Office on March 7,1985. Our objections are as follows:

(1) Modifications to the final permit are not sturmarized or explained anywhere in the Rationale. - This is in violation of the requirements of 40 CFR 124 17. Without this stannary it was very difficult for the EPA staff to determine what changes, if any, were nade to the permit before issuance.

It would be.just as difficult for the public to make stch a determination.

(2)

The permit has been nodified to call for sampling of the turbine building drain, the reactor building drain, and the sewage treatment plant (Part IA 4.). The statement is made that no numeric limits apply _ to the sewage plant effluent. A similar statement is not made for the two c1 rains, but it appears that no limits apply to these discharges as well. Tne two building drains cone under the " low voltrae waste sour s" as defined in 40 CFR 423.11 and must be regulated under the B M-BOT technology-based regairements before dilution with the cooling tower bloadown water (40 CFR 122.45(i),

423.12 and 423.13). The sewage plant also must have technology-based effluent limits applicable to it before dilution.

- Until the above limitations are in the permit, it will be unacceptable to EPA.

t (3) The permit,. as proposed, has no limitations or prohibitions on metal cleaning wastes.

40 CFR 423.13 (e) requires BAT limits for copper and iron that are intended to be met before dilution.

The copper and iron limits in the final discharge do not provide adequate controls because of the dilution involved, and the permit is not acceptable until this is corrected.

EPA-does not recognize or ackno41 edge the legal validity of this recently issued PSC Ft. St. Vrain permit The purpose of this letter is to request that the Division submit to EPA within 90 days of the date of this letter a proposcd permit revised to meet EPA's objections as noted above.

If such a permit is not submitted to EPA within 90 days, EPA will issue a permit to PSC pursuant to 40 CFR 123.44(h).

Please note that if this 90 day deadline is missed, exclusive authority to issue the PSC permit will pass from the State of Colorado to EPA under 40 CFR 123.44(h)(3).

In order to prevent future problems on permit interpretation, several pages of the rationale have been changed to parallel the clarifications of this

A concern previously raised by EPA is the inposition of effluent limitations on internal waste streams as allowed by 40 CFR Section 122. 4S(i).

The wording in this section states that limitations "may be imposed" but does not state that it is mandatory. Based on the fact-that the permit requires monitoring of the individual waste streams and is conditioned to be reopened if treatment cf the waste streats is inadequate, it is the division's position that EPA's cor.cern has been properly addressed.

The Nuclear Regulatory Coc=f ssion (NRC) requires a cinicut flow'of

If a visible sheen is observed, corrective action shall be taken immediately.

4. Monitoring Requirements -. 001 and 002 Self-monitoring samples taken in compliance with the monitoring

-requirements specified above shall be taken at the following location (s):

Monitoring Point 001A - at-the parshall flume at the outf all from the f are pond f or temperature and residual chlorine; and Monitoring Point 001B -

parshall flume.at the Goosequill Ditch for all other parameters when discharge is via'the 001 discharge point.

Discharge Point 002, at the parshall fluce in the drainage slough prior to entering-St. Vrain Creek. All discharge and conitoring points are as

- shown on Tigures 1 and 3 of this permit. TSS levels must be monitored in plant for application of net licitation. See ** on previous two pages of this permit.

5. Effluent Licitations - Discharge Points 003, 004 and 005 During the period beginning im:ediately and lasting throuFh June 30, 1968 the percittee is ' authorized to discharge f rom outf all('s) serial number (s).

003, 004 and 305, subject to the following effluent licitations and conditions:

003 - This discharge shall consist of South Platte River water and shall contain no heat or other chemicals or material other than that removed from the intake screens.

-004 - This discharge shall consist of St. Vrain Creek water and shall

-contain'no heat or other chemicals or materials other than that removed from the intake screens.

005 - This discharge shall consist of sluiced water from the St. Vrain

Creek intake and shall contain no heat or other chemicals or materials other than that removed froc the intake.,

No monitoring of flow or other para eters will be required at these points.

6. Special Monitoring The percittee shall monitor for TSS, BOD and fecal colifore at the sewage treatment plant outfall and for TSS, oil and grease and pH prior to eixing with other flows for the turbine and reactor building drains. Monitoring shall be on a conthly basis and BOD shall be a co:posite sacple while the other paraceters shall be grab samples. No numeric limits shall apply at these points. The monitoring is to serve as an indicator of facility perfortance. If reported analyces show inadequate treatment, the Division

may modify the percit ~ to impose numeric licitations for these parameters.
