Dear Commissioner Palladino:
This letter will bring the Commission up to date with ref erence to the question as to who is the legal representative of the County of Suffolk in the above proceeding, as a result of a recent Court ruling involving Prospect, et al v.
Cohalan.
On July 15, 1985, the original petitioners ( twelve members of the Suf folk County Legislature, suing individually, and four Towns), joined in by the law firm of Kirkpatrick &
Lockha rt, filed a motion in State Supreme Court seeking to
" enforce" Judge Doyle 's decision of June 10, 1985, which an-nulled the County Executive's Executive Order !b. 1-1985 by reinstating Kirkpatrick & Lockhart as the County's attorney in Shoreham related matters.
Their legal argument was that the County Executive 's termination of the services of that firm to represent the County's legal position in the Shoreham licensing proceeding. is violative of.the judgment and, therefo re, should be enjoined.
On July 19 th, a State Supreme Court Justice (J ustice Brown ) rejected that argument and ruled that the County Execu-tive was acting well within his charter powers when he ter-minated the services of the Kirkpatrick firm.
The decision was based on the fact that the Suffolk County Attorney alone is authoriz ed, under the Suff olk County Charter and the County Law, to represent the Jaunty of Suffolk in any legal proceeding or to select outside counsel to assist him, with the approval of the County Executive.
