l ORDER on September 27, 1996, the Atomic Safety and Licensing Board issued a decision and order granting Yankee Atomic Electric Company's ("YAEC") Motion for Summary Disposition of this proceeding.

The Board stayed the effectiveness of its order until October 9, 1996.

LBP-96-18.

On September 30, 1996, Citizens Awareness Network and New England Coalition on Nuclear Pollution ("intervenors") filed with the Commission a motion, pursuant to 10 C.F.R. 5 2.788, to expand the Board's temporary stay into a full stay.

We hereby extend that temporary stay, subject to further order of the Commission, pending our consideration of the intervenors' notion for a full stay and their petition for review.

Intervenors, in their September 30, 1996 Motion for Stay, indicated that they "are prepared to file their Petition for 9610110088 961002 V

Review by Friday, October 4."

We accept intervenor's statement as a commitment to file by that date.

If the NRC staff and YAEC wish to respond to either the Petition for Review or the Motion for Stay, they must do so by Thursday, October 10, 1996.

To be timely, all documents must be served and filed by hand, facsimile transmission or e-mail, so that they are received at the commission no later than 4:15 p.m.,

Eastern Time, on the due date.

This truncated filing schedule is consistent with the Commission's expedited treatment of this proceeding.

We remind the parties that neither the petition for review nor responses thereto may exceed ten pages.

The temporary housekeeping stay which the instant order establishes shall supersede the Board's temporary stay and shall remain in effect pending further order of the Commission.

In addition, at the appropriate time and if necessary, the j
