CHAIRMAN pALLADINO: Good morning, ladies and 3
gentlemen.
4 This is an affirmation / discussion session.
We have 5
one item proposed, and that is the Suffolk County, New York 6
State Motion for a Stay of Low power License.
7 Since this was not previously scheduled, we need to 8
vote to hold this meeting on less than one week's notice.

All right.
Let me ask the 11 Secretary to lead us through this item.
12 MR. BATES:
Mr. Chairman, you are acting on a 13 proposed order here to respond 'to a motion by Suffolk County, 14 State of New York for a stay on the low power license for 15 Shoreham.
16 Yourself, C owm i s s i on er Roberts, Commissioner Zech, 17 and Commissioner Bernthat have approved an order with a 18 modification by Commissioner Bernthat that denies the stay, 19 but puts an administrative stay in effect until Thursday at 20 5:00 p.m.
21 Commissioner Asselstine disapproved the order and 22 has a couple of additional comments that will be attached to 23 it.

Well, let me just make the 5
comment that I think the substance of the reword that 1 6
proposed is the same as the substance of that proposed by 7
Commissioner Zech.
Mine is somewhat more abbreviated, and 1 8
would suggest that General Counsel -- we have to approve --
9 COMMISSIONER ASSELSTINE:
Wait a minute.
Let's 10 approve what we're going to issue, one way or the other.
11 MR. BATES:
I think that's.what you just did.
12 COMMISSIONER BERNTHAL:
All right.
