In accordance with the provisions of 10 CFR 61 regarding req for the land disposal of low-level radioactive waste, the NRC staff has perfomed a technical review of a topical report on the HuPac FL-50/

EA-50 Ferralium 255 high integrity container (HIC). As indicated by the attached draft technical report evaluation (TER), we have concluded from our review that there is reasonable assurance that the proposed use of the FL-50/EA-50 HIC, within the restrictions described in the TER, will not pose a threat to the public health and safety. We also conclude that the topical report submitted by NuPac, supplemented by additional infomation that was provided in response to staff coments and questions on the topical report, adequately describes the FL-50/EA-50 HIC. Our final approval of the topical report is predicated on the anticipated satisfactory revision and re-submittal of proprietary and non-proprietary versions of the report that will incorporate the changes resulting from our review.

A draft Certificate of Compliance is also enclosed. Upon completion of your review, and agreement with the NRC finding sign and return the certificate of compliance so that it can be incorporated into the final topical report. You may wish to include a condition on the certificate with regard to the necessity of using a lead gasket for tritium waste with no vent. You should address any other areas of concerns on the

certificate.
