EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Watzl:

This refers to an NRC inspection conducted at the Prairie Island Nuclear Generating Plant May 22 to July 9,1996. The inspection included a review of modifications installed on your auxiliary feedwater (AFW) pumps and the results of that inspection were sent to you by letter dated September 13, 1996. Based on the information developed during the inspection, the NRC has determined that violations of NRC requirements occurred. Specifically, as required by 10 CFR Part 50, Appendix B, Criterion III, in 1982 you failed to assure adequate design control for a modifi;ation installed on the discharge piping of the AFW pumps. This modification was necessary to protect the AFW pumps against run-out for certain accident conditions. As a result of the inadequate control of the modification's design, the pumps were rendered inoperable under certain conditions, in non-compliance with the Technical Specifications. Normally, escalated enforcement action would be considered for these violations. However, in order to recognize your efforts in identifying problems affecting safety and to give credit for prompt correction of these problems, I have been authorized, after consultation with the Director, Office of Enforcement, to exercise enforcement discretion, pursuant to Section VII.B.3 of the NRC Enforcement Policy (NUREG-1600), and not issue a Notice of Violation in this case. NRC's decision to exercise discretion in this matter is based on it involving an old design issue that (1) was identified by your staff as a result of a voluntary initiative that consisted of a review of your 10 CFR 50.59 safety evaluation program; (2) was promptly and effectively corrected by your staff; (3) would have limited risk consequence for a relatively small number of postulated LOCA events; and (4) would not likely have been identified by routine licensee efforts such as normal surveillance and quality assurance activities.
