IMPOSITION OF CIVIL PENALTY - $7,500 By EN 92-007 dated November 17, 1992, the Commission was notified of the intent of OE to issuo a Notico of-Violation and Proposed Impooltion of civil Penalty in the amount of $7,500 to Capital Materials Tonting, Inc.
The action wan based on a violation-involving a failure to adequately perform a survey of a i
radiographic devico after a radiographic exposure was completed.
The licensee responded to the Notico in a letter dated' December 9, 1992.
In its responso, the licenseo did not deny the violation, but requested remission of the civil penalty.
After careful consideration of the licensee's response, the staff has concluded that the violation did occur as not forth in the Notice of Violation and Proposed Imposition of Civil Penalty _and that the liconnoo failed to provido a bacin for any mitigation of_the civil penalty amount.
Accordingly, an order Imposing Civil Penalty in the amount of
$7,500 has been issued today.
Under the terms of the Order, the-11censeo may within 30 days of the dato of the Order, pay the civil penalty or requent a hearing.
