Dear Mr. Mathes:
Your letter dated December 24, l'.'92, outlined areas in which the Nuciaar Regulatory Commission could be of assistance to the Department of Energy (DOE) in fulfilling mutual responsibilities under Title X of the National Comprehensive Energy Policy Act of 1992.
NRC will coordinate its efforts and provide whatever assistance _it can to 00E.
You propose _that pricr to' DOE's issuance of a-disbursement to a licensee, that NRC concur in the licensee's claimed remedial activities for final closure of-their mill site be in accordance with the applicable requirements of _10 CFR Part 40, Appendix A.
This regulation implements the requirements of the Uranium Mill Tailings Radiation Control Act of 1978 (UMTRCA). As part of their submittal to DOE for reimbursement for work done, the licensee would be required to cross reference their supporting cost documentation to their NRC approved reclamation plan or provide additional information to justify that the remedial action cost was' necessary to ensure compliance with the UMTRCA.
NRC will provide to DOE a review of the licensee's submittal and. where appropriate, will grant the concurrence.
DOE intends to obtain information from the licensee on total site-reclamation costs, including accomplished work and work yet to be done, to establish the funding that the licensee would expect-to receive under Title X.
NRC will-review such information provided to DOE and will then mr.ke any' appropriate adjustments to the surety amounts required in the license under Part 40, You requested a review of DOE's list of potential applicants that may be eligible for reimbursement and information on sureties established by licensee and site ownership. The enclosure details this review and provides the requasted information. The surety date listed is the anniversary of the effective date of the existing surety. Ar.nual updates'to the surety must be.
submitted to NRC at least=3 months prior to that date. The licensee and Parent company, if known, is shown. Our records do not include identification of the owner of the site.
