SUBJECT: NRC INSPECTION REPORT 50-298/93-03 (NOTICE Of VIOLATION)

This refers to the routine safety inspection conducted by

Dr. D. Blair Spitzberg and Mr. Jack H. Keeton of thia office on January 18-22,

1993. The inspection included a review of activities authorized for your

Cooper Nuclear Station. At the conclusion of the inspection, the findinga

were discussed with those members of your staf f identified in the enclosed

report.

Areas examined during the inspection are identified in the report and include

a review of the operational status of the Emergency Preparedness Program.

Within these areas, the inspection consisted of selective examination of

procedures and representative records, interviews with personnel, and

6 valuation of personnel proficiency in performing emergency response duties.

The results of this inspection are documented in the enclosed inspection

report.

Based on the results of this inspection, certain licensed activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violatior (Notice). The violations involved failure to perform required tests

of the Emergency Response Organization paging system and failure to critique

and foibwpp on certain emergency drills as required. These_ violations are of

contarn y.aua they indicate insufficient attention to programmatic

requ!rmnts c ' emergency preparedness. Another violation, discussed in

Section 1.1 of the enclosed report'was identified for failure to submit

changes to an Emergency Plan implementing arocedure to the NRC within 30_ days

of implementation. This violation is not )eing cited, because the criteria in

paragrech Vll.B.2 of Appendix C to 10 CFR Part 2 of the NRC's " Rules of

Practice" were satisfied. This violation was an isolated occurrence, and the

licenset.'s staff took prompt and effective actions to correct the probicm.

You are v quired to respond to this letter and should follow the instructions

specifled in the enclosed Notice when preparing your response. In your i

response, /ou should document the specific actions taken and any additional i

actions yot, plan to prevent recurrence. After reviewing your response to this

Notice, inc#uding your proposed ccrrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirchents.

We also bring to your attention another concern, as discussed in Section 4.1

of the enclosed report, related to your selection of operating crews to

participate in emergency drills and exercises. We noted that for the three

drills and practice exercises leading up to the 1992 annual graded exercise,

,

the scme operating crew was selected for participation that was later

'

evaluated during the annual graded exercise. None of the other five operating

crews were selected for participation in drills or practice exercises during

nearly a 4-month period prior to the graded exercise, and only two other

documented emergency drills were conducted in 1992. In the future, we

strongly encourage you to provide for a more even distribution of the training

experience of drill and exercise participation among your operating crews.

In accordance with 10 CTP ". '00 of the NRC's " Rules of Practice," a copy of
