30tVED JUL-21985 ORDER Attached to a June 30, 1985, letter to us from intervenor Air and Water Pollution Patrol (AWPP) are three documents. The first is AWPP's opposition (dated June 30, 1985) to applicant's June 20, 1985, renewed motion for an exemption. Although AWPP has labeled this filing as "Before the Atomic Safety and Licensing Appeal Board," this matter is pending before the Licensing Board. Accordingly, it will be referred to that Board. A second document is AWPP's June 28, 1985, opposition to applicant's June 24, 1985, motion before the Commission for a different exemption, concerning the conduct of an emergency exercise within one year of license issuance. This filing is properly labeled "Before the Nuclear Regulatory Commission" but has not been served, as required, on the Commission's Secretary. See 10 C.F.R. 5 2.701(a) . This document will therefore be rerouted to the Commission.

2 The third item is AWPP's " reply" to a comment by the NRC staff in a brief filed with us on June 14, 1985, to the effect that an earlier AWPP filing was not timely. Inasmuch as we ruled on the merits of the subject filings in ALAB-809 (issued on June 17, 1985), the timeliness of AWPP's filing and the accuracy of the staff's comment are academic. We advise AWPP, however, that service on this or any other board does not amount to service on the NRC staff, the Commission, or any party. Each such entity must be served i

separately and must be accompanied by a Certificate of Service. See 10 C.F.R. SS 2.701(b) , 2. 712 (e) .
