ORDER ,

On June 24, 1985, the inmates of the State Correctional Institution at Graterford, Pennsylvania filed " Exceptions to the Board's Order of June 12, 1985." In that Order, the Board accepted the contention and two of the proposed eight bases.

In its " Exceptions," which the Board treats as a motion to reconsider our June 12 Order, the inmates seek yet another review of t

their contention and reinstatement of'the six bases reviewed and rejected by this Board in the June 12 Order.

On June 28, 1985 the Board received " Applicant's Answer to

' Exceptions' to the Licensing Board's Order of June 12, 1985 filed by the Graterford Prisoners." This answer opposed reinstatement of the six rejected bases.

A telephone survey by the Board's secretary has determined that the Commonwealth of Pennsylvania and the NRC Staff will not respond to the

-inmates' motion in view of time restraints on all parties. The issue is ripe for decision.

2 The Board has reviewed the aforementioned pleadings, our Order of June 12, and the entire record on the matter of the " Proposed Revised Contentions of the Graterford Inmates with Regard to the Radiological Response Plan" filed May- 13, 1985.

The Board finds the inmates arguments without merit and we reaffirm our Order of June 12, 1985.
