Dear Administrative Judges:
By Memorandum and Order of June 26, 1985, in this proceeding, the Board ruled in part:

By June 26, 1985, CCANP shall file a statement of what it intends to prove -- i.e., its direct case --
throuch the testimony of all non-NRC employees on its list (includingMr.deYoungandHL&Pwitnessesalready scheduled to testify), together with some identification of why it expects each witness to so testify.
Pursuant thereto, CCANP served "CCANP Specification of Testimony Sought From CCANP Witnesses," on June 26, 1985. No matters that CCANP intends to prove through the testimony of Mr. deYoung were set out therein.
Therefore, it appears that CCANP has abandoned its intent to call Mr. deYoung, and no basis exists to subpoena him to testify in this proceeding.
