Dear Mr. Mollere:
Thank you for your letter dated October 28,1992 responding to our inquiry concerning the need for a Solid Waste Standard Permit at the proposed Claiborne Enrichment Center. As you requested in that letter, we spoke with Mr. Lee Lavesspare, Ms. Anita Peterson, and Mr.
Michael Deck cf your office on November 20,1992 to further clarify the design purpose of the facility's hold-up basin. Mr. Lavesspare confirmed that tb hold-up basin will not be regulated by the Solid Waste Rules and Regt!ations because the asin is designed to receive only non-contaminated stormwater and non-contaminated potable water used for testing of the facility's tire protection system.
Additionally, it was requested that we verify whether the wastewater treatment system's reinforced concrete sedimentation basins meet the LDEQ definition of a tank and are therefore also excluded from the Sclid Waste Rules and Regulations. We have reviewed the LDFQ regulatory definition of a tank at Louisiant Administrative Code 33 XI.103 and concluded that the concrete sedimentadon basins clearly meet the detinition of a tLak. This letter is povided to document that information to the LDEQ Solid Waste Division.
