IMPOSITION OF CIVIL PENALTIES - $12,500 By EN 92-068 dated August 28, 1992, the Commission was notified I
of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $12,500 to CTI, Inc.
The action was based on violations involving the-licensee's failure to 1) use a separate alarm ratemeter, 2) conduct complete radiation surveys, and 3) post high radiation areas.
Other violations were classified at severity levels IV and V and-not-assessed a civil penalty.
Violations 1 and 2 were aggregated as a Severity Level III problem.
Based on willfulness, violation 3 was separately classified as a Severity Level III violation.
The licensee responded to the Notice in a letter dated October 6, 1992.
After careful consideration of the licensee's response, the staff has concluded that the violations did occur as set forth in the Notice of Violation and Proposed Imposition and that-the licensee did not provide an adequate basis for mitigation of-the civil penalties.
Accordingly, an Order Imposing Civil' Penalties in the amount of
$12,500 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
