RESOLUTION HO. 4251 WHEREAS, under provisions of the federal Nuclear Waste Policy Act, the United States Department of Energy (DOE) is responsible for high level nuclear waste disposal, and WHEREAS, electric utilities have been and continue to fund such DOE activities through a one-tenth of a cent per kilowatt hour assessment on net electrical generation by nuclear power reactors, and

WHEREAS, to date the District has been assessed the sum of

$40,801,098 and industry funding now exceeds more than $6 billion, and

WHEREAS, all civilian reactor owners have signed contracts with DOE, under which the federal government is to begin accepting high level nuclear waste by January, 1998, and
WHEREAS, DOE recently announced plan revisions which include canceling the search for a voluntary host and site for a Monitored Retrievable Storage Facility (MRS) and identifying a federal government site for interim storage, refocusing spent fuel container design activities on development of a standardized system, taking the Nuclear Waste Fund "of f-budget," and exploring concepts of compensation for utilities if DOE cannot start receipt of spent fuel in January,1998.

HOW, THEREFORE, BE IT RESOLVED by the Board of Directors cf the Omaha Public Power District as follows:

1.

That Management is directed to continue to monitor, and seek periodic reports from the United States Department of Energy (DOE) as to the schedule and cost of the national disposal facility for high level nuclear waste.

2.

That Management is directed to notify DOE that the District supports DOE proposed changes in development of the high level nuclear wasto disposal program and encourages DOE to expedite implementation of said changes.

3.

That Management is directed to contact Nebraska's Congressional delegation to ask for their assistance in expediting enact;ent of any necessary legislation regt tred to implement program revisions.

4.

That Management shall periodically report to this Board the funding imposed upon the District by DOE for high level nuclear waste management, including project schedule and costs associate with both Yucca Mountain permanent repository and the newly announced interim storage project.
