an exemption pursuant to 10 CFR S 50.47 relating to the coverage of the offsite emergency plan for the Limerick Plant as it applies to the Inmates of the State Correctional Institution at Graterford (Graterford).
In its Order, the Board provided for 10 days any parties opposing the issuance of such Order to submit comments.
The Applicant was allowed 5 days to respond.
(The order did not specify whether the comments were to be in hand or simply filed by mailing.)
The Applicant received in the mail today the "NRC Staff Comments On The Licensing Board's May 9, 1985 Order Granting Applicant An Exemption" dated May 20, 1985, and the " State-ment Of Anthony / FOE In' Opposition To Granting Applicant's Motion For Exemption From 10CFR 50.47 (a)

- 1985, both addressed to the Board.
For the record, the Applicant also notes a filing by Limerick Ecology Action with the Appeal Board-dated May 20, 1985, supplementing its previous motion
-for a stay; the Appeal Board's " Memorandum and Order" dated May 21,'1985, dismissing the Graterford inmates' appeal; and the letter from the Secretary of the Commission dated May 20,1985, to the undersigned counsel, all of which discuss and interpret the Board's May 9, 1985 Order.
As the record reflects, Limerick Unit 1 is ready for ascent to power above the present 5% limit. /
The Applicant notes that none of the filings referred to above contains any. new' silbstantive 'informatilon.
Therefore, in an a'ttempt' l
to avoid further delay, the Applicant will not file any further response as provided in the Board's Order of'May 9, 1985.
