Dear Congressman Stark:
I am responding on behalf of the Commiss ion to your November 12, 1992 letter to the Chairman on the subject of Transnuclear Incorporated's application (XSNM-02702), dated July 21, 1992, for a license to export irradiated fuel from the shoreham nuclear power plant in New York to Cogema in France for reprocessing.
In particular, you have requested the Commission to grant the Nuclear Control Institute's October 30 petition for a hearing and for intervention by providing a full oral hearing o.- the pending application.
Subpart I of Part 110 of the Commission's rules provide procedures for public participation in export matters and
" constitute the exclusive basis for hearings on export license applications."

Pursuant to those procedures the Commission is currently receiving responses to Nuclear Control Institute's petition.
Following all timely responses, the Institute will have an opportunity to reply.
The Commission will then consider the petition and all the papers filed on it under the standards provided in 10 C.F.R. S 110.84.
After full consideration, the Commission will issue its decision whether to grant the request for a hearing and if so what form the hearing should take.
Whether or not a hearing is granted, the Commission will, of course, give appropriate consideration to its decision on the license application.
Because the rules do not contemplate quasi-judicial hearings, but rather that any oral hearing would be of the legislative style, there is no ex parte bar to your communichtion.

A copy of the Commission's decision on Nuclear Control Institute's petition will be provided to you.

Dear Chairman Selin:
I am writing to urge the Commission to hold a full oral hearing on Transnuclear Incorporated's application (XSNM-02702) to export irradiated fuel from the Shoreham nuclear power plant in New York to Cogema in France for reprocessing. The Nuclear Control Institute, a public policy research group concerned with nuclear proliferation, filed a petition on October 30 requesting such a hearing.
The application reflects the first effort in more than a decade by a U.S. utility to reprocess spent nuclear fuel. If the application is granted, this could jeopardize nuclear nonproliferation interests by serving as a precedent for other U.S. utilities and could shore up a sagging European reprocessing industry.
Full review is particularly imperative in this case because the Executive Branch has not addressed any substantiative issues raised by the application. I sincerely hope you and the Commission will give the serious issues raised by this licence application the consideration _they deserve, in the form of a full oral hearing.
