3 This is an affirmation / discussion session.. We have 4
three items on the agenda.
I will ask the Secretary to walk 5
us through those items.
6 MR. CHILK:
The first item, Mr. Chairman, is
- 7 SECY-85-136 entitled, Options to respond to the Remand of 8
Guard v. the NRC.
9 In this paper, the Commission is being asked to 10 provide interim guidance to the adjudicatory Boards and the 11 staff until the Commission can conclude its response to the 12 D.C. Circuit Court's remand in the case of Guard v. NRC.
13 The Chairman, Commissioners Roberts, Bernthal, and
,(
14 Zech have approved a policy statement -- with minor 15 modifications suggested by the Chairman -- which provides 16 that interim guidance.
17 The gudance states that the Commission believes 18 Licensing Boards and, in uncontested situations the staff, 19 may find.that applicants who have met the requirements of 20 Section 50. 47 (b) (12) as interpreted by the Commission before the Guard decision, and who commit to full compliance with the 21 Commission's response to the Guard remand, meet the require-22 23 ments of Section 50.47 (c) (1) and therefore are entitled to 24 licenses, conditional on full compliance with the Commissica's Ace-Federal Reporters, Inc.
25 response to the Guard remand.

-16 consideration of the Commission's April 4, 1985 denial of 17 TMIA's February 1, 1985 request for a hearing.
18 The Chairman, Commissioners, Commissioners Roberts, 19 Bernthal, and Zech have approved an order which denies that l

20 request.
Commissioner Asselstine disapproves, indicating he 21 would have taken review on the original 2206 Petition.

Motions for Reconsideration of the Commission's 5
Decision that no Further Hearings are Required.
6 In this paper, the Commission'is being asked to
~7 approve an order concerning the motions of the Commonwealth 8
of Pennsylvania and Three Mile Island Alert that the Commission 9
reconsider its February 26, 1985 decision that no further' 10 ' hearings are warranted in the TMI Restart proceeding.
-11 The Chairman, Commissioners Roberts and Zech have 12 approved an order which denies the motions for reconsideration.
Commissioners Asselstine and.Bernthal have disapproved the 13 y
14 order.
