Dear Senator Craig:

I am responding to your November 5, 1992, letter written to Chairman Selin, on behalf of your constituent, Louis R.

Blas, M.D.,

concerning the annual fees for FY 1991 and FY 1992 for License No. IDA-235, Invoice Nos. AM08224-91 and AM06854-92.

The Omnibus Budget Reconciliation Act of 1990 (OBRA-90), requires that the Commission recover 100 percent of its budget authority, less appropriations from the Department of Energy (DOE) administered Nuclear Waste Fund, for Fiscal Years 1991 through 1995 by assessing license and annual fees.

For FY 1991, the Commission was required to collect approximately $445 million and approximately $493 million in FY 1992 through these fees.

In order to comply with the law, the Commission published its fee regulations in the Federal Register after careful evaluation of public comments.

Enclosed is a copy of NRC's response to Dr. Blas.

The FY 1991 and FY 1992 annual fee invoices have been cancelled.

Dear Dr. Blas:

I am in receipt of copies of your August 19, 1992, October 24, 1992, and November 9, 1992, letters to Senator Larry Craig regarding NRC's annual fees for your materials license issued by the State of Idaho (IDA-235).

As you indicated in your August 19, 1992, letter, effective April 26, 1991, licensees in Idaho became subject to the NRC's regulations including licensing, inspection and annual fees in 10 CFR Parts 170 and 171 because Governor Cecil Andrus informed NRC of his decision to return Idaho's Agreement to NRC.

On April 17, 1991, our Region IV office in Arlington, Texas, notified Idaho licensees of the reassertion authority.

The NRC held a workshop on May 15, 1991, in Boise, Idaho, which included discussion. of NRC's organization, regulations, and enforcement policies as well as a discussion concerning the NRC fees applicable to Idaho licensees.

As stated in the final revision to the Commission's fee regulations in 10 CFR Parts 170 and 171 for FY 1992, _ hich was w

published in the Federal Register July 23, 1992, the Commission exempted from the FY 1992 annual fee those licensees and holders of certificates, registrations and approvals who either filed for termination or for a possession only/ storage license during the period October 1, 1991, through December 31, 1991.

Based on your December 2, 1991, letter to Jack Whitten, your Idaho license IDA-235 was terminated December 9, 1991.

Therefore, the FY 1992 Invoice AM06894-92 for $4,750.00 has been cancelled.

With regard to the FY 1991 Invoice AM08224-91 for $3,500.00, the FY 1991 final rule revising 10 CFR Part 170 and 10 CFR Part 171 provided an opportunity for licensees who wished to relinquish their licenses and who were capable of permanently ceasing licensed operations by September 30, 1991, to avoid the FY 1991 annual fee if the licensee notified the Commission in writing within the 30-day period prior to the effective date of the rule (56 FR 31475 and 31485; July 10, 1991).

As stated in the Federal Register notice, and the notice which was mailed with the invoice, the effective date of the rule was August 9, 1991.

p.2 Because we failed to respond to your July 16, 1991, letter requesting information on changing your license status, you were unable to meet the filing deadline.

Therefore, the Commission:

1) grants an extension to the time to file for termination to December 2, 1991; 2) acknowledges that all licensed activities ceased prior to September 30, 1991; 3) considers your actions timely for purposes of avoiding the FY 1991 annual fee; and
4) acknowledges that your license was terminated on December 9, 1991.

Invoice No. AM08224-91 has been cancelled.
