1. The proposed title to the website is fine. In order for us to prepare the rulemaking documents in advance, please provide the URL link to that site in advance. We must add it to the document prior to sending it to the Office of the Federal Register for publication.
2. The current rulemaking schedule is:
  • 10/23/2020- Planned target date for publication of the proposed rulemaking notice
  • 10/23/2020 -12/22/20 Public Comment period Please note that the above schedule is subject to change and adjustment. No later than 30 calendar days before the planned publication date, NRC rulemaking staff will contact you with an update on the schedule and to make final arrangements. As I described previously, ASMEs staff has assessed the initial steps and necessary information to support the rulemaking process per the NRCs request. Our questions at this time are:

1. Would the following title, for a link page, be accurate and sufficiently clear for your public comment reviewers? If not, please recommend alternative wording.

ASME Code Editions for NRC Public Comment Period of Proposed Rule to amend 10 CFR 50.55a

2. ASME sets a date range for when the files can be opened, after which the files will not open. We need to know this date range prior to finalizing the public access site.
a. What is the current rulemaking schedule? More specifically, what is the planned target date for issuance of the Final Rulemaking Notice?
b. How long will the comment period remain open?

Mr. Sanna, The purpose of this e-mail is to request that the American Society of Mechanical Engineers (ASME) provide limited public access to the attached list of standards which are to be incorporated by references into § 50.55a of Title 10 of the Code of Federal Regulations (CFR).

In the near future, the Nuclear Regulatory Commission (NRC) plans to publish in the Federal Register a proposed rule to incorporate by reference the editions of the Boiler and Pressure Vessel (BPV) and Operation and Maintenance (OM) Codes identified in the attachment to this e-mail. Consistent with ASMEs actions to support the NRCs 2018 proposed rule to incorporate by reference certain ASME BPV and OM Codes (83 FR 56156; November 9, 2018), we are requesting that ASME provide members of the general public with read-only access to Sections III and XI of the 2019 Edition of the BPV Code and the 2020 Edition of the OM Code during the comment period for the proposed rule, which is anticipated in the near term. The NRC is not asking your organization to waive its intellectual property rights to these materials, nor does the NRC seek to undermine or

impair your organization's business model with respect to the development and publication of the BPV Code or the OM Code. The NRC recognizes the value of your organization's efforts to develop and update these standards. Reliance on these standards substantially reduces the amount of resources and time it would otherwise take for the NRC to address design, inspection, and repair of systems, structures, and components in nuclear power plants. ASMEs fulfillment of this request will help the NRC satisfy the Office of the Federal Register requirements in 1 CFR Part 51 regarding agency requests for approval to incorporate by reference into the CFR materials already published elsewhere.

The NRC requests that you respond within 2 weeks of receiving this e-mail; your prompt reply is required to support the rulemaking schedule for the upcoming revision to 10 CFR 50.55a.
