Dear Mr. Conner:

This responds to your letter to the Secretary of May 14, 1985 in which you requested that the Commission commence its imediate effectiveness review, reduce its ten-day comment period and prompcly schedule a meeting for an immediate effectiveness decision. This request is based on the Licensing Board's Order of May 9, 1985 which you interpret to grant an exemption from 10 CFR 9 50.47 and to provide the basis for the authorization of the issuance of a full-power license for the Limerick facility.

In the Comission's view, the Licensing Board's Order of May 9,1985 only indicated an intention to grant an exemption and an intention to issue an order authorizing issuance of a full-power license after receipt and consideration of the coments of the parties solicited by the Board. Of course, any party may seek a clarification of the Board's May 9 order on this point. Therefore, it is premature at this time for the Commission to act on your request.
