STATUS REPORT FOR NRC INVOLVEMENT IN VICINITY PROPERTIES REMEDIAL ACTION PROGRAM UNDER UMTRCA INTRODUCTION:

The Uranium Mill Tailings Radiation Control Act (UMTRCA) requires that the NRC concur in remedial action plans for properties which have been contaminated by residual radioactive materials from certain inactive uranium mills. Because of the large number of contaminated vicinity properties, the NRC reviews in detail only the remedial action plans for unusually significant properties. Remedial action plans for all other properties receive an NRC concurrence if they satisfy certain preset conditions. Unusually significant properties are defined as those with greater than 10,000 cubic yards of contaminated material or those where, because of the use of the supplemental standards in 40 CFR Part 192, the planned remedial action would leave residual radioactive materials in excess of the primary standards. The mechanism for NRC concurrence for routine and unusually significant vicinity property remedial actions plans was discussed in the February 4, 1985 status report.

CURRENT STATUS:

Since the last quarterly status report, 63 concurrences were given for vicinity property remedial action plans. Enclosure 1 presents the current totals by processing site for the vicinity property program. includes all processing sites where DOE has taken action to include or exclude properties in the program. Enclosure 2 is the handout on the vicinity property program provided by Kathy Carlson at the last quarterly DOE / Tribes / States meeting on February 26, 1985. Several of the tables presented in the handout, which refer to NRC resources, were based on NRC review and concurrence on every vicinity property remedial action plan. Memorandum of Understanding (M00) between DOE and NRC would reduce the NRC concurrence role to only those vicinity property remedial actions employing supplemental standards. Until the M00 is finalized, we will continue to follow the concurrence procedures discuss in the last quarterly status report.
