Dear Ms. Riley:

This is in response to your letter dated March 7, 1985, in which you appealed Mr. J. M. Felton's letter dated February 6,1985, which denied-in-part your Freedom of Infomation Act (FOIA) request for documents related to selected NRC contracts for court reporter services. You specifically appealed the denial of portions of the Sumary of Procurement for NRC-21-84-352 dated August 6, 1984.

Acting on your appeal, I have carefully reviewed the. record in this case and have detemined that the denied portions of this record still require with-holding from public disclosure pursuant to Exemptions 4 and 5 of the FOIA (5 U.S.C. 552(b)(4) and (5)) and 10 CFR 9.5(a)(4) and (5) of the Comission's regulations. Therefore, your appeal is denied.

This document contains (1) financial cost and pricing infomation related to performance of stenographic reporting services, the disclosure of which could cause competitive harm to the companies which provided the infomation; and (2) predecisional infomation containing advice, opinions, and recomendations, the disclosure of which would inhibit the candid and frank communication within the NRC staff. Because release of this infomation would reveal important aspects of the deliberative process, disclosure is not in the public interest.

This is a final agency action on your appeal. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), judicial review of this decision is available in a district court of the United States, in the district in which you reside or have your principal place of business, or in the District of Columbia.
