DpR-45 LACl10SSLMilitiCdaillLilEAC101L(LACM11 01CEET NO. 50-4Q2 1.0 jlfl((QQU[1LQlj By letter dated October 28, 1992, the licensee, Dairyland Power Company (OPC) requested an amendment to facility license No. OpR-45 for its LACBWR. The amendment would modify the Technical Specifications by deleting the requirement that the Radioictive Effluent Release Report be submitted on a semi-annual basis and adds the requirement that the Radioactive Effluent Release Report be submitted annually in accordance with 10 CfR Part 50.36a.

In addition, the amendment eliminates the collection and reporting of hourly meteorological data. The LACBWR license was amended on August 4, 1987, to authorize possession only but not operation of the reactor located at Genoa, Wisconsin. The LACBWR has been shutdown since April 14, 1987. Defueling of the facility was completed on June 11, 1987.

2.0 EVALVAllDff The licensee has requested that the Radioactive Effluent Release Lepet. be submitted annually in accordance with the revised requirement of 10 t,ck part 50.36a. The reason for the requested change is 10 CTR part 50.36a has been revised and now requires that a Radioactive Effluent Release Report be submitted annually, previously, 10 CfR part 50.30a required a semi-annual submittal, The staff find.; the subittal of an annual report consistent with the current regulations.

The amendment also eliminates the collection and reporting of hourly meteorological data. The justifications for eliminating the collection and reporting of meteorological data are: a) the use of historical site specific meteorological data, b) the use of conservative atmospheric dispersion coefficients, and c) the fact that after approximately s's- years of no operation of the reactor and six years of decay of the raolonuclides within the plant, the effluents from the stack contain a negligible amount of radioactive gases and particulates, for the first six months of 1992, no radioactive gases were detected in the stack emissions, and particulate activity emissions were measured at 4.6 E-7 curies for the entire period.

Because LACBWR has been shutdown since 1987 and no radioactive emissions were detected in the first six months of 1992, the staff finds the use of conservative site atmospheric dispersion coefficients based on site specific MOI W

historical data will result in conservative maximum annual dose estimates to the public from effluent releases. The staff finds this meets the requirements of 10 CFR 50.36a.

3.0 Lil11RQHENIAL CQXSIDERAT10111 The amendment involves a change to reporting requirements. Accordingly, this amendment meets the eligibility criteria for categorical exclusion set forth in 10 CfR 51.22(c)(10). Pursuant to 10 CFR Sl.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the 4 issuance of this amendment.

4.O M E LQS10U The Commission has concluded, based on the considerations above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proaosed manner, (2) such '

activities will be conducted in compliance will the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
