Dear Senator lugar:

This is to acknowledge receipt of your letter dated December 10, 1992, transmitting correspondence from your constituent, Dr. Stephen P. Coburn, Fort Wayne State Developmental Center, expressing his agreement to a petition for rulemaking to revise 10 CFR Parts 170 and 171 of the Nuclear Regulatory Commission's (NRC) fee regulations.

The petition for rulemaking was submitted to the NRC by the American College of fluclear Physicians and the Society of Nuclear Medicine.

The petitioners requested that the NRC modify current fee regulations to minimize the impacts of NRC imposed fees on the practice of nuclear medicine.

The NRC published a Federal Register notice (57 FR 46819, October 13, 1992), requesting public comment on the patition.

The notice provided for a 60-day public comment period which expired December 14, 1992.

I want to assure you that the comments of your constituent will be considered along with the others in evaluating the fee regulations.

However, it would Le premature at this time to predict the outcome of the evaluation before final disposition of the petition for rulemaking.
