Dear Mr. Wallo,
This is in response to your letter of June 1:?, 1992, in which you requested that Nuclear Regulatory Commission staff review and provide comments on the Department of Energy's (DOE's) Radiation Ccntrol Criteria for Mixed Waste Project Outline.
NRC staff is currently reviewing this document and intends to forward comments to you in the near future.
The ca7 cept proposed in the document is similar to the Below Regulatory Concern (BRC) Policy that was published in June 1990, by MRC.
As you are no doubt aware, public concerns over the BRC policy compelled the Commission to defer consideration of all BRC waste petitions and impose a moratorium on implementing the 1990 BRC policy.
The Commission has instead decided to go forward at this time with a participatory rulemaking on radiological criteria for decommissioning.
Several ongoing projects may have an impact on the development of tne Raciation Control Criteria.
These projects include the Environmental Protection Agency's (EPA's) Hazardous Waste Identification Rule and the broader efforts by DOE, EPA, and NRC on residual radioactive material.
NRC agrees that the establishment of a formal worxing group, made up of representatives of DOE, NRC and EPA is needed to coordinate the activities involved in this project.
As such, NRC is ready to participate in such a working group when it is established.
