This action is based on the licensee's failure to file NRC Form 241 and the Agreement State specific license with the NRC when performing licensed activity in non-Agreement l
States.
The Radiation Safety Officer (RSO) was aware of the requirement in August 1990 and had copies of the forms, but found it too burdensome.
The RSO stated he intended to file the NRC Form 241; however, the workload and pressure of other duties precluded him from filing.
Normally, the failure to comply with 10 CFR 150.20 is categorized at a Severity Level III;.
j however, due to the careless disregard for regulatory requirements exhibited by the RSO, the violation has been j
categorized at a Severity Level II.
The base civil penalty is
$800 for a Severity Level II.
The penalty was reduced by 50 percent because of prompt corrective actions and escalated by 50 percent because NRC identified the violation, by 100 percent for i
prior notice to identify, and by 100 percent for multiple occurrences.
It should be noted that the licensee has not been specifically informed of the enforcement action.
