Dear Dr. Still:

This is in response to your letter dated OctoDer 9, 1992, in which you requested action on your request for termination of the plutonium facility license, and on your application to dispose on your site uranium contaminated soil meeting the Branch Technical Position Option 2 limits.

The technical review of the plutonium license is complete, and we =are - -

proceeding to publish the environmental assessment (EA) and terminate the - 4 license in a matter of weeks.  ?

We are also completing our review of the onsite burial. Tohelpcomploieouhl"t"_

review, we need some additional information on the 10:CFR. 20.302 onsitel disposal. You are requested to provide your proposed measure.s to control

subsidence and wind and water erosion at the disposal area Eincluding -

revegetation of the surface. Because we also wish to have the burialtmadet known-by (1) having a notice placed in the property title 1 describing t.he' '

burial and (2) having the location marked, please include.a description of -

markers (cairns or similar)~to be placed at-the burial corners. c As has been mentioned in an earlier conversation,- we' have been- taking a broad look at the decomissioning of the Cimarron site and have elected to regard it as three major parts, two being those you addressed in your letter of October 9, 1992. . The third part is the decomissioning of the remainder of .

Please advise us of ~your schedule for submitting the Characterization Resort-and the Decomissioning Plan.

The ActioniPlan (57 FR 13389,-; April 16, 1992),. indicates that. existing

, guidance and practices are to be.used in establishing the decomissioning l

residual radioactivity levels. :Cimarron Corporation.should specify in -the-Decommissioning Plan all cleanup criteria it will. be using, including any others in addition to the Branch Technical ~ Position, 46 FR 52061,~0ctober 23,

i. 1981, and Policy and Guidance Directive 83-23, November 4, 1982, including its-L Enclosures 2 and 3.

.. .~ The Characterization Report and the Decommissioning Plan must address all aspects of the site which exceed residual radioactivity criteria for release for tfnrestricted use. Grounddater contaminatior must be addressed, including

'any chemical contamination that may remain. from licensed processes, especially chemicals which can influence the groundwater transport of uranium. Further, the five former wastewater ponds that were closed in 1978 must be addressed in detail. A thorough characterization of these ponds (where they might have contamination exceeding the criteria) must be included, and the Decommissioning Plan must describe how you plan to address any contamination in excess of levels acceptable for release for unrestricted use.

By Amendment No. 9 (signed December 28, 1992) to license No. SNM-928, Kerr-McGee Corporation is authorized to backfill the ttro sewage lagoons and the former burial ground at the Crescent, Oklahoma, site. The Decommissioning Plan should address any impacts of conditions in these areas upon the decommissioning of the remainder of the site.
