This is in reference to a decision issued by a U.S. Department of Labor (DOL) administrative law judge involving a former employee of the Bechtel Power Corporation, a contractor to Entergy Operations, Inc., at the Arkansas Nuclear One (AN0) facility.

In a complaint filed with the D0L in May 1991, this former employee alleged that he was fired from his job at ANO and denied other employment opportunities as a result of raising concerns about the disposition of Engineering Action Requests at ANO. However, in a September 21, 1992, Recommended Decision and Order issued by a DOL administrative law judge in Case No. 91-ERA-0046, the DOL found that the complaint was without me-it.

This decision has been forwarded to the Secretary of Labor's office for review and a final determination.

In a December 23, 1991, letter, the NRC informed Entergy Operations, Inc.,

that it was deferring action on this matter pending the outcome of the hearing before the D0L administrative law judge.

Unless the administrative law judge's recommended decision is overturned on appeal, the NRC considers this matter closed and requires no further information from Entergy Operations, Inc.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
