MODiflCATION TO STATEMENT OF WORK FOR FIN L-1647 I am requesting that PMDA issue a work order to modify Phase 11 and Phase 111 of tne Statement of Work (50W) for FIN L-1647 as outlined below.

1. Include the following at the end of the section entitled " Task 5 -

Collect and Analyze Mixed Waste Data." " Participation by NRC and Agreement State licensees in the survey outlined in Phase 11 is considered to be voluntary in nature. As such, ORNL may only encourage-licensee participation. ORNL may not claim, or make representations, that response by licensees to requests for information by ORNL is mandatory or required. Participants will be_ offered the greatest degree of confidentiality possible. NRC and EPA are not collecting-this data with the intent of taking any enforcement actions against survey respondents. Unless a future development, involving the protection of the public health and safety and the environment, warrants the release of the names of the survey respondents,0RNL will not provide NRC or EPA any _information on the identity of any licensees contacted in relation to this project. Except as outlined above, data and results-from _the survey will only be provided to NRC, EPA or other groups or individuals, as approved in writing by the HMSS PM, in an aggregated format, stripped of any specific licensee identifiers."

2. Include the following at the end of the 'section entitled " Task 8 -

Document Results." "At the conclusion of Task 8 ORNL will retain all raw data-that contains-information or-licensee identifiers (e.g.,

completed survey forms, follow-up call notes and records, records of interviews with licensees, etc.) regardless of the form of the record (e.g., hard copy, computer disk, etc.) for seven years. After seven _

. years from the completion of Task 8 ORNL shall destroy this information.  ;

ORNL may retain only that information and data for which written approval has been obtained from the HMSS PM."

ANNOUNCING PLANS FOR MIXED WASTE SURVEY The purpose of this notice is to inform you of an upcoming survey and to

, request your support in making this effort a success. The U.S. Nuclear Regulatory Commission (NRc) and the U.S. Environmental Protection Agency (EPA) are conducting a voluntary survey to collect information to develop a national profile on the volumes, characteristics, and treatability of commercially generated mixed waste. Mixed waste is waste that contains a radioactive -

component subject to the Atomic Energy Act (AEA) and a hazardous component subject to the Resource Conservation and Recovery Act (RCRA). The Office of Management and Budget has approved the agencies' plan to survey some 1200 respondents. Since this survey will be limited to approximately 1200 respondents, not every licensee who receives this letter will receive a survey j questionnaire. We hope to be in a position to begin the actual survey by September 1991. The results of the survey will be published in the Spring of 1992, i

This project was undertaken by the two agencies at the request of the Host State Technical Coordinating Comittee (TCC). In May 1990, a letter was sent to NRC Cnairman Kenneth M. Carr and EPA Administrator William K. ileilly, by the

{ TCC, requesting the development of a national profile on the volumes and i characteristics of commercially generated mixed waste. The stated intent of the national profile should be "... to provide needed information to States and i compact officials, private developers, and federal agencies to assist in the l planning and development of treatment and disposal facilities for mixed waste."

As a result of this letter and consultations between NRC, EPA, and the Department of Energy (DOE), a contract was awarded to Oak Ridge National Laboratory (ORNL), to initiate work on this study.

4 This study began with an evaluation of past State, compact, and industry survey data to determine if these data are adequate for compiling a national mixed waste profile. At the conclusion of this initial phase, ORNL found that there was much useful existing information, but that the many different survey objectives and survey methods used, as well as the different timeframes involved in earlier surveys, argue against sole reliance on 'the existing data.

ORNL recommended that a new survey be undertaken, and tha two agencies adopted this recommendation.

The survey results are expected to help m3et-the current information needs of NRC, EPA, States and compact officials, and private developers. This information is expected to: (1) provide States and compacts with information to assist in planning and developing adequate disposal capacity for low-level radioactive waste, Radioactive Waste Policyincluding Amendments mixedAct;waste,(as mandated by the Low-level 2) provide clearer idea of the characteristics and volumes of mixed waste and the technical capability and capacity needed to treat this waste; and (3) provide a reliable national data base on the volumes, characteristics, and treatability _

of commerciul mixed waste. This data may also serve as a basis for possible federal actions to effectively manage and regulate the treatment and disposal of mixed waste.

The agencies' intent in conducting this survey is to collect accurate and complete information on mixed waste for the reasons outlined above. The data are not being collected for any enforcement purpose. Survey responses will be submitted to and retained by ORNL. Survey results will be provided to NRC and EPA stripsed of any facility identification.

published ay NRC or EPA would not identify individual facilities.Also, any survey results States, compact officials, and generators of low-level radioactive waste are asked to support and cooperate with this survey to help ensure that compilation of a national profile will be a meaningful and credible undertaking. The agencies' goal is to achieve at least a 75-percent response rate for this survey. Agreement State cooperation and support are especially needed to ensure that the survey provides a truly national profile. Therefore, NRC and EPA are particularly-seeking the aid of Agreement State officials to f acilitate making contact with Agreement State licensees. Because of the time-sensitive nature of the project, and our need to compile a national data base, we plan to make direct contact with Agreement State licensees in distributing the survey questionnaire. 111e November 22 issue of the NRC's WerAly /nformation Report, Enclosure B, p. 2, reports on the completion of a pretest questionnaire for the National Profile on Mixed Waste. Tliis task, the report entry says, was performed by ORNL, with questionnaires sent to 20 licensee rnembers 01 ACURI. The responses have now been catalogued and tabulated.

After a search through the NRC's L Street Public Document Room, we are unable to Dnd these materials.

Pursuant to 5 U.S.C. 552(a)(4)(iii) governing FOIA requests and fee waivers,I am requesting the following documents:

(1) ORNL's completion of the data from this survey and any accompanying discussion.

(2) A copy of the questionnaire sent out to the licensees.

(3) Copies of the licensees' responses.
