Attachment 1 Georgia Institute of Technology Reply to a Notice of Violation Inspection Report No. 50-160/92-04 Violation 50-160/92-04-1, Severity Level V (Supplement VIII)

Section 3. 2 _ of the licensee's Emergency Preparedness - Plan specified that the State of Georgia and the. Atlanta /Fulton County Emergency Management Agency (EMA) -will be notified for all incidents classified in accordance with the Plan as Notification of- Unusual Event (NOUE) through General Emergency.

Section 6.4.b(8) of the licensee's Technical Specifications stated that written procedures shall be provided and utilized for a site emergency plan.

The procedure - intended by the licensee to implement the requirements of Section 3.2 of the Emergency Preparedness Plan was Emergency Procedure 6100, " Emergency Notification" (Revision 03, approved September 26, 1991).

Contrary to the above, Emergency Procedure 6100 did , not require notification of the State of Georgia for all incidents classified as-NOUE, and did not specify notification of the

, Atlanta /Fulton County EMA for any incidents classified as NOUE through General Emergency.

1. Admission or denial of the violation:

The Georgia Institute of Technology agrees with the viol'ation as stated.

2. The Reason for the Violation:

A corrective action 'in response to a previous noncited violation.(50-160/91-01-01) was undertaken-by the Manager of the Office of- Radiation Safety immediately after the.

L inspector's exit interview. This Manager later resigned. It:

L -was the Director's understanding that the_noncited violation l was corrected. The' updated procedure, thought.to contain the corrected noncited _ violation, but did not,' was approved by the Nuclear Safeguards Committee on September. 26, 1991.

3. Corrective steps which have been taken and the results achieved:

A new Manager for the Office of Radiation Safety has been hired.

Procedure 6100 has been reviewed and modified. The modified version will be submitted to the Nuclear Safeguards Committee for approval at the next (January 1993) meeting of NSC.

To avoid possible communication problems, action on items ra.'. sed at exit interviews will henceforth be reviewed after NNRC receives the inspection report.

All potential Emergency Directors have been notified of the prospective change in Procedure 6100 and are prepared, to notify Atlanta /Fulton County EMA for any incident classified in accordance with the Emergency Preparedness Plan.

4. Corrective Steps which will be taken to avoid further violations:

O As soon as the revised Procedure 6100 is approved by the Nuclear Safeguards Committee, all staff at NNRC will be trained in how the procedure is applied.

Action items in response to inspection exit interviews will henceforth be reviewed for adequacy after the inspection report is received at NNRC.

5. Date when full compliance will be achieved:

Full compliance will be achieved by March 1, 1993.
