This is in response to your letter dated July 1,1985 (your reference #LA 85-48),

in which you requested a temporary exception from a commitment in your Fundamental Nuclear Material Control Plan (FNMCP).

He have determined that the alternate nJthod you proposed for measuring incin-erator ash is suitable either on a temporary basis or a pemanent basis. Since you cnly intend to use the alternate method for a temporary period, no FNHCP revision is necessary. Authorization for the alternate measurement technique will be by license condition as specified below.

We have also determined that the granting of your request will not adversely affect the common defense and security nor the public health and safety, and is otherwise in the public interest. Accordingly, we are issuing an unnumbered license condition to Amendment SG-2 of your License No. SNM-1107 to read as follows:

Notwithstanding the commitment contained is Section 3.6 and Figure 3.3 of the Plan identified in Condition 2.1, pertaining to the methodology for measuring incinerator ash, the licensee may measure incinerator ash eitrer by the Plan specified method or by the method described in the enclosure to the licensee's letter dated July 1,1985(reference code LA65-40). This condition shall expire on December 31, 1985.

We have determined that the enclosure to your July 1,1985 letter contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such infomation is deen.ed to be connercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public discitsure unless subject to the provisions of 10 CFR 9.12.
